Terms of Service

1. Acceptance of Terms

By accessing and using ExperimentBets, a service provided by Prediction Labs Inc. ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ExperimentBets is a B2B SaaS platform that gamifies A/B testing by allowing team members to place virtual currency bets on experiment outcomes through Slack. The Service includes:

• Integration with experimentation platforms (Amplitude, Statsig, etc.)
• Slack bot functionality for placing bets and receiving notifications
• Web dashboard for monitoring experiments and leaderboards
• Virtual currency system for betting (no real money involved)

3. User Accounts

To use the Service, you must create an account or authenticate through Slack. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Virtual Currency

The virtual currency ("coins" or "credits") used in ExperimentBets has no monetary value and cannot be exchanged for real money, goods, or services. The virtual currency is provided solely for entertainment and engagement purposes within the platform.

5. Subscription and Billing

5.1 Subscription Plans

ExperimentBets offers multiple subscription tiers: Free, Team, Growth, and Enterprise. Each paid plan includes a specified number of Monthly Active Players (MAP) at no additional cost. If your organization exceeds this included player count, additional players will be charged at a per-player overage rate. Plan features, included player limits, and overage pricing are detailed on our pricing page and may be updated from time to time.

5.2 Billing Cycles

Paid subscriptions may be purchased on either a monthly or annual billing cycle. By subscribing to a paid plan, you authorize us to charge your designated payment method for the applicable subscription fees. Annual subscriptions are billed upfront for the full year at a discounted rate. All subscriptions automatically renew at the end of each billing period unless cancelled.

5.3 Monthly Active Player Limits and Overage Charges

Each subscription plan includes a Monthly Active Player (MAP) limit. The current MAP count is calculated based on a rolling 30-day window, not calendar months. If your organization exceeds the MAP limit for your plan, overage charges will apply. Overage charges are calculated based on the number of additional active players beyond your plan limit at the end of each monthly billing period, and are billed on a monthly basis regardless of whether your base subscription is monthly or annual. Overage rates vary by plan tier and are detailed on our pricing page. You will receive notifications when approaching or exceeding your MAP limit.

5.4 Free Trial

New customers may be eligible for a 30-day free trial of paid features. Each organization (company) is entitled to one free trial only. A valid payment method may be required to start a free trial. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription, and you will be charged the applicable subscription fee.

5.5 Cancellation and Refunds

You may cancel your subscription at any time through the subscription management page or by contacting support. For base subscriptions, cancellation will take effect at the end of the current billing period (monthly or annual), and you will retain access to paid features until that time. However, if you have incurred overage charges for additional players, please note that overage billing always operates on a monthly cycle. Upon cancellation with active overages, you will retain overage-related access only until the end of the current monthly overage billing period, regardless of your base subscription billing cycle. We do not provide refunds for partial billing periods, unused time on annual subscriptions, or overage charges already incurred. Upon cancellation, your account will revert to the Free plan.

5.6 Plan Changes

You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately, and you will be charged a prorated amount for the remainder of your current billing period. Downgrades also take effect immediately; however, no refunds are provided for unused time on your previous plan.

5.7 Payment Failures

If a scheduled payment fails, we will attempt to process the payment again and may notify you to update your payment information. If payment cannot be collected after reasonable attempts, your subscription may be suspended or downgraded to the Free plan.

5.8 Price Changes

We reserve the right to modify subscription pricing. For existing subscribers, we will provide at least 30 days' notice before any price increase takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5.9 Enterprise Plans

Enterprise plans are available with custom pricing, features, and terms. Enterprise agreements are negotiated separately and may include additional or different terms than those described in this section.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Transmit any viruses, malware, or other harmful code
• Impersonate any person or entity

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Prediction Labs Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, Prediction Labs Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
